Tax representation for non-residents

Selling property in Spain? Modelo 210 is not optional.

As a non-resident, selling your Spanish property comes with obligations before the Spanish Tax Agency that do not end at the notary. CAUSA.E acts as your tax representative in Spain and handles them for you.

What the law requires

Three obligations for a non-resident seller.

Ignoring them is costly: surcharges, penalties and a 3% withholding that is never recovered.

01

Appoint a tax representative in Spain

Depending on your country of residence and circumstances, Spanish law requires you to appoint a representative before the Tax Agency. In every case, you need someone in Spain accountable for your obligations. That is our role.

02

The 3% withholding · Modelo 211

At signing, the buyer withholds 3% of the price and pays it to the Tax Agency with Modelo 211. That money is yours: a payment on account of your tax.

03

Declare your gain · Modelo 210

Modelo 210 declares the result of your sale. It is where the 3% withheld is offset and, if it exceeds the tax due, where it is recovered.

The key filing

Modelo 210: the backbone of a legally sound sale.

A Modelo 210 correctly calculated and filed on time is the difference between closing your sale with peace of mind and carrying a problem with the Tax Agency.
